Unpaid Taxes

The IRS has instituted a program that allows taxpayers the opportunity to compromise the amount of back taxes they may owe. The program provides that taxpayers may make, and the IRS may accept, offers-in-compromise of the unpaid taxes. Offers-in-compromise can be made in two distinct situations: when there is doubt as to the tax liability based on current tax law or when there is doubt as to collectibility of the tax based on the taxpayer's ability to pay the tax.

In either situation, the IRS procedures must be followed in order to obtain an offer-in-compromise that allows the taxpayer to reduce, through compromise, the unpaid tax. Some states also have offer-in-compromise programs.
