Probate Administration

When a person dies, his/her affairs have to be settled and his estate distributed. Oftentimes, this requires the filing of an application for probate - whether or not the decedent had a will at the time of death.

Probate administration involves the appointment of an executor or administrator who is responsible for: (i) securing and accounting for all assets owned by the decedent at death; (ii) ascertaining and paying (assuming there are adequate assets to do so) all debts that are owed by the decedent; (iii) ascertaining and paying all income and death taxes that are owed; (iv) preparing and submitting a final accounting to the probate court; and (v) seeing to the final and proper distribution of estate assets.
