Disabilities Discrimination

In 1990, Congress enacted the Americans with Disabilities Act (ADA) that is designed to protect the rights of persons with disabilities in a broad range of activities including employment, public accommodations such as hotels, stores, public transportation, restaurants, theaters and other public buildings.

In the employment context, employers and prospective employers are required to make "reasonable accommodations" for employees who have disabilities. What constitutes a "disability" is not clearly defined. Examples include physical infirmities, vision or hearing impairments, and certain medical conditions.
