ERISA Claims

The Employee Retirement Income Security Act of 1974 ("ERISA") was designed to foster the creation of private employment retirement plans and to protect employees' rights with respect to such plans. ERISA also applies to other employee benefit plans such as those providing health insurance, health benefits, and accident and disability benefits.

ERISA protects employees by establishing minimum vesting requirements (how long one must be employed and under what conditions) for participation in the plan. In the case of retirement plans, ERISA also provides funding protection by requiring employers to make minimum annual contributions to the plan.
